SCOPE OF THESE TERMS
These Terms of Service govern your access to and use of The Biosignal Platform, including our website, software, app, subscriptions, digital services, support services, and related products provided by Cinematronic ApS.
By accessing or using The Biosignal Platform, you agree to these Terms of Service. If you do not agree to these terms, you must not use the platform.
These Terms of Service should be read together with our Privacy Policy and our Delivery, Shipping and Returns Policy.

USE OF THE PLATFORM
The Biosignal Platform is a software tool for user research, biosignal recording, analysis, content evaluation, and related research or testing activities.
You agree to use the platform only in accordance with applicable laws, these Terms of Service, and any instructions, documentation, or license conditions provided by us.
You are responsible for ensuring that your use of the platform is lawful and appropriate for your intended purpose.
LICENSE AND ACCESS
Subject to these Terms of Service, we grant you a limited, non-exclusive, non-transferable, and revocable right to access and use The Biosignal Platform for your own internal, professional, educational, research, or evaluation purposes.
You may not copy, resell, sublicense, modify, reverse engineer, decompile, or attempt to extract the source code of the software, except where such restriction is not permitted by applicable law.
Access to the platform may require a valid user account, internet access, third-party authentication, license activation, subscription, or payment.
FREE TRIALS, SUBSCRIPTIONS AND PAYMENTS
The platform may be offered with a free trial, limited trial period, subscription plan, paid license, or other commercial arrangement.
The available plans, prices, billing periods, and payment terms are shown before purchase or agreed separately in writing.
Continued use after a free trial may require a paid license or subscription.
If you purchase through a third-party platform, such as Microsoft Store, payment, cancellation, refund, and delivery handling may also be subject to that third-party platform’s own terms and policies.
If you purchase directly from us, payment may be handled by Cinematronic ApS or by a payment provider acting on our behalf.
DIGITAL DELIVERY AND WITHDRAWAL RIGHTS
Software licenses, subscriptions, in-app purchases, and digital services are delivered digitally.
If you are a consumer, you may have a statutory right of withdrawal for certain online purchases. For digital products and services, this right may end once digital delivery or access has started, if you have expressly requested immediate access and acknowledged that you lose your right of withdrawal when delivery begins.

USER DATA AND RESPONSIBILITY
You are responsible for the data, recordings, test material, participant information, survey answers, video files, biosignal data, and other content that you upload, collect, process, or analyze using the platform.
You are responsible for ensuring that you have the necessary permissions, consents, legal basis, and rights to collect, upload, process, analyze, and store such data.
If you use the platform to collect or process personal data, including biometric, behavioral, health-related, or research participant data, you are responsible for ensuring compliance with applicable data protection laws, including GDPR where applicable.
Our processing of personal data is described in our Privacy Policy. Where required, a separate data processing agreement may apply.
RESEARCH, ANALYSIS AND RESULTS
The Biosignal Platform provides tools for recording, displaying, analyzing, and exporting data.
We do not guarantee that the platform will produce any specific research outcome, scientific conclusion, commercial result, diagnostic result, or decision-making result.
You are responsible for reviewing, validating, interpreting, and applying any data, measurements, analysis, visualizations, exports, or results generated through the platform.
The platform is not a medical device and must not be used for medical diagnosis, treatment, or clinical decision-making unless this has been separately agreed in writing and is legally permitted.
THIRD-PARTY SERVICES, HARDWARE AND INTEGRATIONS
The platform may rely on or integrate with third-party services, software, authentication providers, operating systems, cameras, sensors, biosignal devices, or other hardware.
This may include, for example, Microsoft services, Google login, Microsoft login, webcams, eye tracking software, Shimmer devices, or other compatible devices and services.
We are not responsible for the availability, performance, reliability, accuracy, security, pricing, licensing, or continued operation of third-party services, software, or hardware.
Your use of third-party products may be subject to separate terms, licenses, or fees from the relevant third-party provider
ACCURACY AND AVAILABILITY
We aim to provide a reliable and useful platform, but we do not guarantee that the platform will always be uninterrupted, error-free, secure, or compatible with all devices, systems, files, sensors, or use cases.
The platform may be updated, modified, improved, suspended, or discontinued from time to time.
We may perform maintenance, release updates, change features, fix errors, or remove functionality where needed.
INTELLECTUAL PROPERTY
The Biosignal Platform, including the software, design, user interface, visual elements, documentation, graphics, logos, trademarks, text, code, and related materials, is owned by Cinematronic ApS or its licensors.
You may not use our intellectual property except as allowed under these Terms of Service or with our prior written permission.
You retain ownership of your own data, uploaded content, test material, and research material, subject to the rights you grant us where necessary to operate and provide the platform.
ACCEPTABLE USE
You must not use the platform to:
Violate applicable laws or regulations.
Infringe the rights, privacy, or intellectual property of others.
Collect or process personal data without the necessary legal basis, permissions, or consents.
Upload malicious code, attempt unauthorized access, or interfere with the operation of the platform.
Resell, sublicense, or make the platform available to others without permission.
Use the platform in a way that could damage, overload, or compromise our systems or services.
SUPPORT
We may provide support through email, website forms, help materials, documentation, or other support channels.
Support availability, response times, and included support services may depend on your license, subscription, or separate agreement.
We do not guarantee that all issues can be resolved or that support will be available at all times.
TERMINATION AND SUSPENSION
We may suspend or terminate your access to the platform if you breach these Terms of Service, fail to pay applicable fees, misuse the platform, or use the platform in a way that may harm us, other users, or third parties.
You may stop using the platform at any time.
Termination does not affect any rights or obligations that should reasonably continue after termination, including payment obligations, intellectual property rights, confidentiality obligations, limitations of liability, and data protection obligations.
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, The Biosignal Platform is provided on an “as is” and “as available” basis.
We are not liable for indirect losses, loss of profits, loss of revenue, loss of business opportunities, loss of data, research delays, failed studies, reputational damage, or other consequential losses arising from the use of the platform.
Nothing in these Terms of Service limits any rights that cannot be limited under applicable consumer law.
BUSINESS CUSTOMERS
For business customers, including companies, institutions, universities, laboratories, agencies, public organizations, and other professional users, additional or separate terms may apply.
Business use may be subject to separate quotation, invoice, license, subscription, service, data processing, or delivery terms.
Unless otherwise agreed in writing, business customers are responsible for ensuring that the platform is suitable for their intended use before relying on it.
CONSUMER RIGHTS
If you are a consumer, these Terms of Service do not limit any mandatory rights you may have under applicable consumer protection law.
Information about delivery, withdrawal rights, returns, refunds, and complaints is provided in our Delivery, Shipping and Returns Policy.
CHANGES TO THESE TERMS
We may update these Terms of Service from time to time.
The latest version will be available on our website. If changes are material, we may provide notice where reasonably possible.
Continued use of the platform after changes have taken effect means that you accept the updated Terms of Service.
GOVERNING LAW AND VENUE
These Terms of Service are governed by Danish law, unless mandatory consumer protection rules in another country apply.
For business customers, any dispute arising out of or in connection with these Terms of Service, The Biosignal Platform, or related services shall be brought before the Court of Aalborg, Denmark, unless otherwise agreed in writing.
If you are a consumer, this does not limit any mandatory rights you may have under applicable consumer protection law, including any rights regarding jurisdiction and venue.
